Back in 2019, my mother and her cousins had the land they inherited from their grandmother surveyed. At that time, neither my mother nor her cousins were very knowledgeable about the proper process of handling and documenting inherited land, so they simply relied on whatever the geodetic engineer advised them to do.
My mother was the only one who was in Leyte at the time, so she was the one who took care of most of the matters related to the land on behalf of the family.
A few months after the land was surveyed and measured, the geodetic engineer gave my mother the survey plan. However, the plan had not yet been approved.
The geodetic engineer did not give them clear instructions about what needed to be done next. He only mentioned that there was an issue that needed to be settled with a neighbor who had purchased a portion of my grandmother’s land. He also said that there was a missing document, but he never explained exactly what document was needed or how they could obtain it.
Since my mother was not familiar with the proper process or the documents required for the land, she did not know what else to do. She simply left the matter as it was, and eventually, it was almost forgotten.
Then, just last week, my mother suggested that we consult a lawyer about the land issue. She no longer wanted to go back to the geodetic engineer because she had recently learned that he was already involved in personal problems and was no longer properly performing his responsibilities. At that point, we felt that consulting a lawyer would be the best way to finally understand what went wrong and what steps we needed to take next.
It turned out that the portion already purchased by our neighbor was still included in the survey plan, even though it should have been excluded. The updated tax declaration should have reflected only the remaining portion.
The lawyer advised us to first go to the Assessor’s Office to have the tax declaration updated, and then have the remaining land surveyed again.
It was a bit frustrating to realize that the issue could have been avoided if we had been properly guided from the beginning. This experience taught us that when dealing with something as important as land, it is always better to seek advice from experts in the field. It may cost a little upfront, but it can save you a lot of time, money, and headaches in the long run.
